By downloading, installing, or using the PitchMe mobile application ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.

2. Description of Service

PitchMe is an ear training application designed to help users develop their musical skills through gamified challenges, including chord recognition, interval training, and note identification exercises.

3. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Share your account credentials with others
  • Use the App to harass, abuse, or harm others
  • Attempt to reverse engineer or modify the App

4. Intellectual Property

The App and its content, including but not limited to text, graphics, images, audio, software, and design, are owned by PitchMe and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

5. User Content

You retain ownership of any content you create or submit through the App. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the App.

6. Privacy

7. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITCHME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

9. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will cease immediately.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PitchMe operates, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms in the App or on our website. Your continued use of the App after such changes constitutes acceptance of the new Terms.
